Terms of service

Please read this information and agreement thoroughly and carefully before booking a trip; it contains important terms and conditions regarding the trip you are purchasing including, but not limited to, our rights to cancel or alter the tour, our cancellation and refund policies, and a limitation of our liability and other important disclaimers.

AGREEMENT 

The terms and conditions set forth in this agreement constitutes the entire understanding and agreement between you the trip “Participant” and Me Time International INC. (“Me Time International”) with respect to any and all bookings, tours, or transactions made with Me Time International through any of its online platforms including but not limited to tailor-made tour and metimejptravel.com.

By making a booking, you accept all of the terms in this agreement and direct us to perform services on your behalf. All persons named in this booking (“Participants”) are subject to this agreement. By making a booking, you affirm that you have made all other Participants listed in the booking aware of these terms – regardless of how final payment is made – and that all Participants accept these terms.

PRICING

The trip price is in U.S. dollars, based on two persons sharing a room or cabin and includes the services specified in the daily itineraries, including specified meals, accommodations, admission fees and guided activities as stated. 

A single room supplement is paid by participants who request single accommodations, which are subject to availability and paid separately.

Pricing is accurate as of the time of publishing but might change from time to time. Trip prices are subject to change without notice. Unless otherwise specified, prices do not include any local taxes or use-fees, including foreign departure, security, port charges, park fees, customs, immigration, agricultural, passenger-facility charges or international transportation tax.

INCLUSIONS

The price of your trip includes any item not specifically listed the Me Time International as well as Me Time Japan Travel webpage or in the itinerary. These usually include but are not necessarily limited to:

• Accommodation and meals as listed in the itinerary
• Transport as listed in the itinerary
• Sightseeing, activity, and entry fees as listed in the itinerary
• The services of a Trip Leader(s) as described in the itinerary

EXCLUSIONS

The price of your trip does not include any services not explicitly listed on the Me Time International as well as Me Time Japan Travel webpage. These exclusions usually include but are not limited to:

• Passport and all visa fees; any other travel documentation; immunizations and medications, as required.
• Transfers to and from home airport. Transfers at starting and ending points of tour on domestic tours and, if not using or meeting group transfer, on international tours. 
• International flights and other transport to/from the country beginning and end points of the Me Time Japan Travel International itinerary
• Activities, excursions or extensions noted as optional or any special pre or post tour arrangements.
• Individual travel insurance
• Excess baggage charges
• Food and beverage other than that specified in the itinerary
• Internal flight charges not included in the Trip price (when applicable)
• Permit charges, destination fees or other charges not included in the trip price (when applicable)
• Single Supplement charges (when applicable)
• Any expenses incurred in preparing for the trip such as but not limited to passport, visa or pre-trip medical fees, gear or other supplies, and insurance
• Personal expenses such as laundry, telephone and alcoholic beverages including wines, liquors, à-la-carte orders, meals other than specified in the itinerary.
• Any other items not specifically mentioned as included.
• Tour cancellation/trip interruption/baggage/accident insurance.

The value of the booking may be subject to taxes, duties, foreign transaction, currency exchange or other fees. Your bank or credit or debit card company may convert the payment into the local currency and charge fees, resulting in differences between the amount displayed on the http://metimejptravel.com website or its affiliated websites, and the final amount charged to your bank account or credit or debit card statement. Please contact your bank or card company if you have any questions concerning any applicable conversion or fees.

DEPOSIT REQUIREMENTS

For some trip departures and at Me Time International’s sole discretion, Participants may elect, in lieu of full payment, to pay a Trip Deposit/Booking Reservation of typically 8 to 10% of the trip cost per person to guarantee your participation on the trip, subject to our Terms and Conditions.

When making a Trip Deposit/Booking Reservation, full payment is due 90 days prior to the trip’s scheduled departure date. Me Time International will email reminders at least 5 days before full payment is due, with a link to submit full payment and pay your balance due. If you make a Trip Deposit/Booking Reservation for a trip departing in fewer than 90 days, the balance of payment is due either 30 days from the date your Trip Deposit/Booking Reservation is received by us, or 60 days prior to your trip’s departure date, whichever is sooner. Please note that a higher deposit amount may be required for some selected trips.

If full payment is not received when due, Me Time International reserves the right to cancel your Trip Deposit/Booking Reservation, and to apply a 100% cancellation fee.

All room supplements must be paid when making a Trip Deposit/Booking Reservation. This includes solo travelers who request a “Single – No Share” room (if available for your specific trip departure). Advance payment is required to guarantee single rooms.

All other booking terms and conditions apply to Trip Deposits/Booking Reservations, including our cancellation policies (see CANCELLATION BY THE TRAVELER, below).

CANCELLATION BY THE TRAVELER

In order to cancel your participation on the trip, you must provide Me Time International with written notification of your cancellation by email to design@metimejptravel.com

Cancellation fees will be applied per person, based on the date we receive your written notification. Unless otherwise noted for specific departures, cancellation fees are based on the following schedule:

     61 – 119 days / 50% of trip price*
     0 – 60 days / 100% of the trip price*

For Tailor-made tours, cancellation fees are based on the following schedule unless otherwise noted in writing:

     61 – 90 days / 50% of trip price*
     0 – 60 days / 100% of the trip price*

Trip price is the listed trip price including single supplements, pre- and/or post-arrival accommodations, and/or any fees and discounts applied to your confirmed booking. Departure date is the date the trip begins regardless of the date that you may depart from your location of origin. We will refund the applicable balance to you using the original payment method for your Booking or Trip Deposit/Booking Reservation.

If you cancel your participation 60 or fewer days prior to the group arrival date, a cancellation fee of 100% of the cost of all services booked through we will apply. 

We will refund the applicable balance to you using the original payment method for your Booking or Trip Deposit/Booking Reservation.

No refunds will be provided for any reason for the unused portion of a trip once the trip begins, including if you leave a trip for any reason or have to be removed from a trip. The trip price is a package cost and refunds and credits are not available for services not used.

If you fail to show up for a trip, leave a trip for any reason after it has commenced or miss any features thereon, no refunds or compensation for unused services will be made. This policy applies equally if you fail to show up for pre- or post-trip travel arrangements and/or if you miss any features thereof.

No exceptions to this cancellation and refund policy, including for reasons related to weather, terrorism, civil strife, personal, family or medical emergencies or any other circumstances beyond our control. For this and other reasons, Me Time International encourages you to purchase trip cancellation and interruption insurance and travel protection (i.e., travel medical insurance and emergency evacuation services).

Me Time International is not responsible for expenses incurred by Participants in preparing for a trip (eg. nonrefundable advance purchase air tickets, equipment, etc.) or for any additional arrangements pre or post-departure date. The term applies whether the tour is altered, modified, or canceled by Me Time International or by you for any reason. Because the tour may be canceled when a minimum number of Participants have not signed up, we recommend that you either purchase refundable air tickets or wait until we have confirmed with you approximately 3 months prior to the tour that we have a sufficient number of Participants.

CHANGE OF ITINERARY

Cancellation by Me Time International and/or tour operator reserve the right to cancel any tour due to low enrollment, inability to operate the tour or due to concerns about the safety, health or welfare of participants. While Me Time International endeavors to operate all trips as described, Me Time International reserves the right to change the trip itinerary, accommodations, activities, transportation, Trip Leader, or any other element of a trip either before the trip departs or during the trip itself. You acknowledge that travel requires considerable flexibility. The itinerary provided for each trip is representative of the types of activities planned, but the route, schedules, activities, accommodations, site visits, amenities, mode of transport, and any other trip elements may be altered or changed without prior notice due to health, safety, security, quality, group size, local circumstances or events, or any other concerns as deemed necessary by Me Time International, in its sole discretion.

When a tour is canceled for foreseeable reasons, then you agree that a full refund of trip payments made to Me Time International will constitute full settlement of any claims you may have against Me Time International or our suppliers, partners, or travel intermediaries.

In the rare event that we is forced to cancel or reschedule a trip for any unforeseen circumstance beyond the reasonable control of Me Time International, such as, but not limited to, acts of nature, war, labor strikes, earthquake, flooding, pandemics, quarantines, international travel restrictions, national emergencies, etc., we will reschedule your trip departure, and your booking will automatically transfer to the rescheduled date. If you are unable to travel on the rescheduled date, you may keep 100% of your booking value as a Trip Credit, to be used on any traveling within 24 months of the issuance date. Otherwise, if you elect to cancel your booking, the following cancellation terms apply, based on your trip’s original travel date:  

• 120 days or more from departure date: Receive a full refund, minus a $600 per-person service fee
• 61 to 119 days: Receive a 50% refund
• 60 days or less: There is a 100% cancellation fee

When you cancel a booking for any reason, including electing not to travel on your trip’s rescheduled travel date, there is a $600 per-person service fee. This is to offset unrecoverable costs to we including credit card fees, non-recoverable deposits, non-refundable permits and booking fees, local taxes and administration costs.

We commit non-refundable, non-recoverable trip payments well in advance of scheduled departure dates. We will use reasonable efforts to recover and refund booking balances to guests when possible. However, we do not guarantee recovery of any or all of the advance payments made, and the use of reasonable efforts to recover these payments will not include the institution of legal proceedings in foreign jurisdictions. For this and other reasons, we encourage you to purchase trip cancellation and interruption insurance.

TAILOR-MADE ITINERARIES

In order to check and confirm availability for Me Time International Tailor-made tour, there is a $600 non-refundable planning deposit to secure the arrangements on your trip. In order to check and confirm availability for a Tailor-made tour, Me Time International require a 25% non-refundable deposit to start confirming all of your arrangements. This will be applied to your final trip cost. The balance of your Tailor-made tour cost is due between 180 and 90 days prior to travel. Specific payment terms will be communicated to you once your initial deposit is received.

PAYMENT REQUIREMENTS AND ACCEPTANCE OF BOOKINGS

Any outstanding trip-related cost must be paid no later than 90 days prior to departure. Failing to provide full payment by this date may result in cancellation of your trip and loss of prior payments made. The cost of extra services booked later than 90 days prior to departure must be paid immediately upon booking. Failing to provide full payment for extra services immediately upon booking may result in the cancellation of those services, unless otherwise stated on the Trip Itinerary page (see DEPOSIT REQUIREMENTS). 

Payments must be in U.S. dollars and may be made by PayPal, or by Visa, Master Card, Discover, or American Express credit cards. There is no charge or service fee for processing credit or debit card payments. Payments will be listed as Me Time International or Me Time International INC. on the credit or debit card statement.

A booking is not final or confirmed until you receive a confirmation from Me Time International by email. Early bookings are recommended because Me Time International’s tour group size and departure dates are limited.

Me Time International reserves the right to decline any booking for any reason permitted by law, including those described in other sections of this agreement.

CREDIT CARD AUTHORIZATION FOR POST-BOOKING CHARGES 

You authorize Me Time International to charge your credit card for any cancellation fees or supplemental payments that you incur post-booking.

AGE 

Travelers must be at least 18 years old by the trip departure date. Exceptions to this policy are only valid if agreed to in writing by Me Time International. Me Time International trips do not have an upper age limit. However, to enjoy the travel experience, participants should be in good physical and mental health. Participants should have sufficient stamina to keep pace with a full day of activities and should be able to walk over uneven terrain and climb stairs. Me Time International will make reasonable efforts to accommodate participants with disabilities on all of its tours, but not all tours may be suitable for all participants.

MEDICAL AND HEALTH REQUIREMENTS

All participants must ensure that they are suitably fit to allow full participation in the trip without hindering the experience of other travelers. Please be prepared for very full and active days. All trips require mobility. Walking on uneven surfaces and up and down hills is common. Travelers must be able to participate in all activities under their own power and not require assistance from the Trip Leader, local staff or any traveling companions. Please contact Me Time International with questions about mobility or health concerns so we can discuss the suitability of any particular trip with you. As a general rule, wheelchairs and most walking devices (not including hiking poles) cannot be accommodated unless specifically approved in advance by Me Time International. Should you decide not to participate in certain parts of the tour or not to use certain services included in the tour, no refunds will be made for those unused parts of the tour or services.

Me Time International reserves the right in our sole discretion to accept, decline, or remove anyone from a trip (at departure or during the trip) who Me Time International judges to be incapable of meeting the trip’s physical demands.

DIETARY RESTRICTIONS & ALLERGIES

Any dietary restrictions should be conveyed to us within 30 days of your booking date. It is not possible to accommodate dietary restrictions or allergies on every trip. You are solely responsible for determining whether the food/drink you consume is consistent with your dietary requirements or preferences. Me Time International is not responsible for cross-contamination or instances where you are served or provided food or drink, by Me Time International or others, with ingredients that do not meet your dietary preferences or restrictions.

PASSPORT AND VISAS

All travelers must have a valid passport. Passports must be valid at the time of the trip. As a general rule, passports must be valid for at least six months after the dates of travel and/or have at least two blank pages for entry/exit stamps. Travelers are responsible for ensuring that they have all visa(s), passport, vaccinations, and other documentation with them in order to enter Japan and to reenter the country or other place of origin. All names on documents must match the legal name on traveler’s photo identification, and travel document information must match tickets. Scans or copies of passports or other documents required by Me Time International in order to participate in a trip. Any travel disruptions or expenses incurred as a result of missing or incorrect documentation is the responsibility of the traveler, with no refund or compensation for any disruption or missed or unused services.

TRIP START DATE

It is your responsibility to be ready to embark on the trip as specified in the itinerary. Me Time International is not responsible for any losses due to canceled or missed flights, changed flight itineraries, late arrivals, or early departures. 

RESPONSIBILITY

Me Time International acts only as an intermediary for the various independent suppliers that provide lodging, meals, transportation, sightseeing, activities or other goods and services connected with your trip (“Supplier” or “Suppliers”). You acknowledge that you are aware and clearly understand that these Suppliers are independent contractors, are not managed by Me Time International, and are not agents or employees of Me Time International. A Supplier’s services are subject to the Supplier’s own terms and conditions and the local laws and regulations of the relevant country.

TRAVEL INSURANCE 

The trip price does not include travel insurance. We strongly recommend that you purchase comprehensive travel protection, covering trip interruption and cancellation, baggage, medical, accident/life, evacuation, repatriation and other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to you. You also agree to assume all costs of medical care, evacuation, transportation, and related costs.

AUTHORITY ON TRIP

Me Time International’s trips are run by Trip Leaders. The decision of the Trip Leader or Me Time International is final on all matters with the potential to affect the safety, comfort or well-being of any person participating in the trip, the group itself or any third party. If you fail to comply with a decision made by the Trip Leader or Me Time International, or interfere with the well-being or mobility of the group or are disruptive or abusive to other guests or third parties, the Trip Leader or Me Time International may remove you from the trip immediately, with no right of refund or compensation, either full or partial. Should a guest be asked to leave a Trip in progress, there will be no refund of any portion of the Trip price, used or unused, nor will Me Time International be responsible for any additional expenses incurred by the Participant as a result of this dismissal.  

PERSONAL DATA

The purposes for which Me Time International collect your personal information when you register or email Me Time International are: administering the site, sending you a password, contacting you about your content and keeping in touch with you. You can access and update your personal information in the ‘profile’ section at any time.

Me Time International may disclose information about you to Me Time International’s authors (some of whom work on contract to Me Time International) and other Me Time International companies. If your content breaches these terms or the law, Me Time International may pass your details and IP address on to a law enforcement agency. Me Time International will not sell your contact details to marketing companies for spamming. COMPLIANCE WITH LAW

You must at all times comply with the laws and customs of the places visited on the trip. We will not be liable for transgressions or violations, intentional or unintentional, of local laws or customs and the consequences that result therein. Participants are subject to all local laws, ordinances and regulations. Violations can lead to fines, imprisonment and/or deportation, among other penalties and consequences. 

PRE-DEPARTURE DOCUMENTATION

It is important that you carefully read all trip-related documents that you receive from Me Time International by email as soon as you receive them, including the Traveler Information form. It is your responsibility to contact Me Time International if any information is incorrect. Me Time International cannot accept any liability if you do not notify Me Time International of any inaccuracies within thirty (30) days of your receipt of those documents.

ACCEPTANCE OF RISK

You acknowledge that the nature of the trip is adventurous and participation involves risk of injury, sickness, or death. It is your own responsibility to acquaint yourself with relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel. Both the United States Department of State and the Centers for Disease Control provide valuable, country-specific information regarding health and safety information. See https://travel.state.gov/content/travel/en/traveladvisories/traveladvisories.html/ and https://wwwnc.cdc.gov/travel/notices. 

RELEASE OF LIABILITY

Me Time International INC., its employees, shareholders, officers, directors and affiliates (collectively, “we”), except for the employment of certain Trip Leaders, does not own, manage or operate any person or entity which is to or does provide goods or services for you trip, including, for example, lodging facilities, transportation companies, guides or trip leaders, food service providers, equipment suppliers, entertainment venues, ground operators, etc., including, without limitation, various entities which may utilize the Me Time International name. 

Me Time International is not responsible for any negligent or willful act or failure to act of any such person or entity, nor for any act or inaction of any other third party not under its control. In addition, I release we from its own negligence and assume all risk thereof.

Without limitation Me Time International is not liable for any direct, indirect, consequential, or incidental damage, injury, death, loss, accident, delay, inconvenience, or irregularity of any kind which may be occasioned by reason of any act or omission beyond its control, including, without limitation, any willful or negligent act, failure to act, or breach of contract of any third party, such as an airline, train, vessel, hotel, restaurant or food supplier, bus, taxi, van, local outfitter or guide, whether or not it uses the Me Time International name, which is to, or does supply any goods or services for this trip. 

Me Time International is not responsible for any loss, injury, death, or inconvenience due to acts of God, force majeure, or acts of government, delay or changes in schedule, overbooking or downgrading of accommodations or any defects therein, insolvency or bankruptcy of a supplier or others, default of any third party, epidemics or the threat thereof, terrorism or the threat thereof, bites or attacks by animals, insects or pests, sickness, the lack of appropriate medical care, evacuation to same, if necessary or meaningful delays in obtaining any medical assistance. In addition, medical assistance when rendered may not be comparable with that obtainable in the participant’s home. Participant assumes all such risks as well as those associated with high elevation diseases, extreme or unusual physical exertion for which participant is not prepared, risks associated with food or impure water, weather, strikes conditions on and perils of the seas such as storms or currents, availability of any transportation mechanism or its arrival or departure timely or safely; war; quarantine; criminal activity; or any other cause beyond we’s direct control.

Me Time International reserves the right to change or reprice any trip, extension or expedition due to acts of insurrection, strikes, acts of God, or any other cause beyond its control. Me Time International may, as it deems advisable, among other things, postpone or cancel a trip, alter or omit any part of the itinerary; substitute hotels, leaders or trip features; or change any means of conveyance without notice and without refund, with the liability for increased costs, if any, to be borne by travelers. If Me Time International cancels any trip, extension, or expeditions, or portions thereof, due to acts of insurrection, strikes, acts of God or government, epidemics, acts of terrorism, third party default or insolvency or any other cause beyond its control, its sole obligation is to issue credits in the full amount of moneys paid to Me Time International but only to the extent its suppliers are crediting Me Time International with those moneys paid by Me Time International to them. 

Under no circumstances is Me Time International obligated to refund the cost of any purchased travel insurance. Me Time International is not required to cancel any program for any reason including without limitation, United States Department of State, Centers for Disease Control, World Health Organization or other Warnings or Advisories of any kind. There are no refunds for unused goods or services. While traveling to Me Time International destinations, disruptions and situations may occur, including, but not limited to, delay, partial or complete changes in timing or routing of itinerary, changes in trip leaders, changes in grades of or location of lodging and modes or quality of air, land, and/or sea transport. Me Time International may make last-minute decisions to address changed circumstances. Me Time International does not guarantee conformity with the itinerary or itineraries that have been posted or furnished to Me Time International.  Me Time International reserves the right to accept or reject any person as a trip member at any time. All trip bookings are subject to acceptance by Me Time International in New York, New York.

IMAGES RELEASE 

Participant grants Me Time International express permission to take photographic or video records of its participants and of trips for any use, including any medium, promotional and commercial use, but not limited to print, electronic media, or Internet, free of charge and without compensation to trip members for promoting and publicizing our travel products and services worldwide. 

Participant grants Me Time International permission to use, reproduce, distribute, display, perform, and prepare derivative works of these images and voice for any purpose. If you do not want Me Time International to use any images of you that are taken by Me Time International or other participants during the tour, you must inform Me Time International or your tour leader in writing at the start of the tour.

TRIP CREDITS

Me Time International may, at its sole discretion, offer Participants a Trip Credit that can only be redeemed through the Me Time International platform on or before the Expiration Date. When you make your next Booking or Trip Deposit/Booking Reservation, Me Time International will reduce the amount up to the current balance of your Trip Credit. If your Trip Credit balance is insufficient, Me Time International will require payment to cover the difference. You are not required to apply the Trip Credit to your next booking and may elect to apply it to a later booking, subject to the Expiration Date.

If you apply a Trip Credit to a Booking or Trip Deposit/Booking Reservation that: (i) you cancel, the amount of the Trip Credit you used for the canceled booking will NOT be reinstated for a future use; or (ii) Me Time International cancels, the amount of the Trip Credit for the canceled booking will be reinstated for a future use.

Trip Credits: (i) are non-refundable and non-transferable; (ii) are not cash, currency and not a stored value, gift card or store credit product; (iii) cannot be redeemed for cash, check or credit, except where required by law; and (iv) cannot be used or reissued past the Expiration Date. You may not purchase or sell Trip Credits and Me Time International does not sell Trip Credits. Trip Credits are the property of Me Time International.

Me Time International reserves its right to refuse, void, cancel, reject or hold for review your Trip Credit, for any reason at its discretion. If for any reason you believe that there is a discrepancy regarding your Trip Credit, please contact Me Time International. Me Time International may require you to submit additional information in order to make a determination regarding your Travel Credit.

By accepting a Trip Credit you are agreeing that the Trip Credit is in lieu of any refund you might be entitled to receive in connection with canceling the Booking or Trip Deposit/Booking Reservation. You release Me Time International from any and all claims and liabilities, without limitation, relating to the Booking or Trip Deposit/Booking Reservation, and/or any refund or compensation you might be entitled to in relation to canceling the Booking or Trip Deposit/Booking Reservation.

PARTICIPANT RESPONSIBILITY

I am responsible for being in sufficiently good health to undertake my trip and for consulting with my personal physician for medical advice. I am responsible for reading and acting in accordance with all pre-departure information, including all health-related information; for bringing all equipment and clothing suggested on the trip packing list and for acting in a manner considerate of fellow group members and the communities visited. Smoking, vaping and non-prescription drug use (including but not limited to cannabis or cannabis products) are prohibited on Me Time International trips. I am responsible for knowing and following all local laws and regulations as they relate to prescription and nonprescription drugs. I cannot carry or use any prescription drugs illegal in a particular country or destination. I am aware that such violations may be treated very seriously and include imprisonment as well as fines, deportation, etc. Some hotels and other facilities may have designated tobacco smoking areas. Under no circumstances can participants bring or use firearms or drones on a trip.

MEDICAL AND HEALTH ISSUES

I take full responsibility for my medical, psychological, and physical condition for the duration of my travels with Me Time International. I am unaware of any medical, psychological, or physical problems that would, in any way, impair my ability to complete the trip safely or to engage in all of the activities of it, nor am I aware of any health-related condition or limitation that might impact the safety, security, or comfort of my traveling companions. Should I receive any new information regarding my health before my trip departs, I will notify Me Time International and my Trip Leader. Should any health-related problems arise during my travels with Me Time International, I will immediately notify the Trip Leader and take full responsibility for promptly accessing necessary and appropriate medical care. I take full responsibility for all medical costs or care I may require during or after my travels with Me Time International. Me Time International is not responsible for medical expenses or the quality of medical care I incur or receive during or as a result of my trip, including in the event that Me Time International, its contractors, or affiliates coordinate or otherwise arrange for medical care to be provided to me. 

COVID RELEASE AND ISSUES THEREWITH AND WITH OTHER TRANSMISSIBLE DISEASES SUCH AS MONKEY POX

You are aware that while on or traveling to or from your trip, you might be exposed to COVID-19 (or some other transmissible disease) from other people, animals or objects. You assume all risk of any such contacts, including sickness, incapacity or death and agree to hold harmless we from any such developments. In addition, you recognize that the U.S. Department of State as well as the Centers for Disease Control and Prevention may have warnings concerning same. Me Time International currently requires that all travelers be fully vaccinated against COVID-19 by the trip departure date. Vaccination cards, including booster shot data, should be carried with you. Some countries/facilities, etc., may require their presentation to gain entry.

You accept the following risks of participating on this trip including, without limitation:

1. All other risks associated with coronavirus (COVID-19) or other transmissible diseases, including preclusion from public or private buildings, land or areas, inconvenience, limitations and closures, preclusion from land or air travel,
2. Risk of your travel insurance not covering COVID-19 or other transmissible disease-related claims;
3. All risks regarding transportation problems including, without limitation, entry into or exit from any country, travel within a destination, and/or difficulties with or closure of transportation systems or the unavailability of other features or attractions within the country, state or area where the trip takes place;
4. The likelihood that at some or all destinations or facilities and/or on cruises, motor coaches or at hotels or restaurants or Me Time International or others may require you to undergo a temperature check, wear a mask while in public, observe social distancing requirements and/or produce evidence of a full vaccination (including booster shots) against COVID-19 and/or other transmissible diseases;
5. The potential for being quarantined if you test positive for COVID-19 and/or other transmissible diseases and/or show symptoms even if you do not have COVID-19. If you test positive for COVID-19 or show symptoms, you will be required to quarantine, following CDC recommendations, and will not be able to rejoin the trip unless expressly approved by Me Time International. The need to quarantine will be determined by the Me Time International Trip Leader or other representative or agency of Me Time International at its sole discretion,
6. The possible requirement, from Me Time International or others, that you provide a negative COVID-19 test immediately before or on or after arrival at your destination or immediately prior to re-entry into the United States; the possible requirement that you take one or several COVID-19 tests upon arrival, whether or not you are showing any COVID-19 symptoms, and/or when other travelers, Trip Leader, local staff or anyone else known to be in contact with you or the group test positive for COVID-19 or show any symptoms thereof. Failure to test when required to do so may result in quarantine and/or removal from a trip, with no refund or compensation for any disruption or unused services;
7. Any expenses incurred, including but not limited to medical expenses, testing fees, quarantine (accommodations, meals, transportation, etc.) and evacuation/travel expenses (airline costs, change fees, etc.) as a result thereof are to be borne by you.

BAGGAGE AND PURCHASES

Baggage and personal property are at the owner’s risk at all times, including when they are in hotel rooms, in transit or when entrusted to Me Time International employees or independent contractors. Me Time International recommends against bringing expensive jewelry, electronics, or other valuables on the trip. 

Me Time International will not be held responsible for any theft, loss, damage, destruction or other issue with personal belongings resulting from participation on an Me Time International trip, regardless of the cause of such.  All purchases are at your own risk including risks related to shipping, storage, quality and conformity with descriptions.

NON-TRIP ACTIVITIES

Non-trip activities do not form part of the trip. Any assistance given by your trip leader or local representative in arranging such activities does not render Me Time International liable for mishaps thereon in any way. The contract for the provision of that activity will be between you and the activity provider.

CLAIMS & COMPLAINTS

If you have a complaint during your trip, please inform your Trip Leader or Me Time International’s local representative at the time in order that they can attempt to rectify the matter.  While Me Time International strives to provide you with a comfortable and enjoyable trip, your notice to Me Time International or its suppliers of a complaint does not mean that Me Time International will accept liability or responsibility, and Me Time International will evaluate each complaint as it arises. 

At the same time, failure to raise a concern or complaint while you are on the trip will extinguish or reduce any ability to claim recourse from Me Time International or its suppliers. Further, if you attempt to address the problem on your own without using this notice procedure, you assume responsibility for any added costs you may incur and forfeit any potential remedy. If satisfaction is not reached through these means then any further complaint should be put in writing to Me Time International within fifteen (15) days of the end of the trip.

SEVERABILITY AND HEADINGS 

If any provision of this Agreement shall be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render the agreement unenforceable or invalid as a whole. Such unenforceable provision will be replaced with one that is valid and enforceable and which achieves, to the extent possible, the original objectives and intent of the original provision. Titles and headings of this Agreement are for convenience only and shall not affect the construction of any provision of this Agreement. 

PRIVACY POLICY

Any personal information that Me Time International collects about you may be used for any purpose associated with the safe and effective operation of a trip. The information will be disclosed to service providers as necessary in order to enable Me Time International to operate the trip.

CONTRACTUAL CHANGES

Changes in this document can be made only in writing signed by an officer of Me Time International.

LANGUAGE USED ON TRIPS

Trips are conducted solely in English.

SUCCESSORS AND ASSIGNS 

This agreement shall inure to the benefit of and be binding upon Me Time International and the Participant and their respective heirs, legal personal representatives, successors and assigns.

UPDATING OF TERMS AND CONDITIONS 

Me Time International reserves the right to update and/or alter these terms and conditions at any time. It is your responsibility to be familiar with these terms and conditions.

APPLICABLE LAW AND CHOICE OF FORUM 

Any dispute arising out of this agreement, including all tort claims and any dispute relating to bookings, tours, or transactions made with Me Time International— whether such dispute arises in contract or in tort or otherwise – shall be resolved exclusively by the state and federal courts located in New York, New York, and you agree to the personal jurisdiction of those same courts. The laws of the State of New York, USA, govern this agreement.

MERGER 

This Agreement is the final, complete and exclusive statement of the parties’ agreement on the matters contained in this agreement. It supersedes all previous negotiations and agreements.

LIABILITY, ASSUMPTION OF RISK & INDEMNIFICATION 

All travelers are required to accept Me Time International’s Liability Waiver, which is a legally binding agreement. Please read this carefully and be prepared to accept and acknowledge the waiver at the appropriate time, prior to your trip departure.

MEDICAL CERTIFICATION 

I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in the Tour, or else I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in the Tour, or else I am willing to assume the risk of and bear the costs that may result, directly or indirectly, from any such condition.

BINDING ARBITRATION

I agree that any dispute concerning, relating or referring to this Agreement, the brochure or any other literature concerning my trip, or the trip itself, shall be resolved exclusively by binding arbitration pursuant to the Federal Arbitration Act, 9 U.S.C. §§1-16, according to the then existing Comprehensive Arbitration Rules & Procedures of the Judicial Arbitration and Mediation Services, Inc. (JAMS). Such proceedings will be governed by substantive (but not procedural) New York law and will take place in New York City, New York. The arbitrator and not any federal, state, or local court or agency shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, conscionability, or formation of this contract, including but not limited to any claim that all or any part of this contract is void or voidable.  Any arbitration commenced against Me Time International must be on behalf of only the signatory to this Agreement and his or her immediate family members who traveled with the signatory, such as a spouse or child. Under no circumstances can participants be part of a class or other joint action.

By agreeing to these terms and conditions, you (and Me Time International) are waiving Me Time International’s right to a trial by jury. 

These Terms & Conditions and Binding Arbitration Agreement (Agreement) shall be legally binding upon myself, and if applicable, my children or wards under the age of 18 at the time of my signing this document. It is my intention fully to assume all of the risk of travel and to release Me Time International from any and all liabilities to the maximum extent permitted by law. This Agreement is applicable to any trip to which I may transfer. 

I certify that I am fully vaccinated against Covid-19 (per CDC guidelines) or will be before the trip departure date. I acknowledge that I may be required to show proof of vaccination if requested by Me Time International.

THE FOLLOWING APPLIES TO END USERS WHO LIVE OUTSIDE THE US:

WE ARE NOT RESPONSIBLE TO YOU OR ANYONE ELSE FOR ANY LOSS, DAMAGE, LIABILITY, COST OR EXPENSE SUFFERED IN CONNECTION WITH THE USE OF THE SITE OR ANY CONTENT OR SERVICES AVAILABLE VIA THE SITES. THE SITES ARE PROVIDED “AS IS”. THE INFORMATION ON THE SITES IS GENERAL AND MAY NOT BE SUITABLE FOR YOUR PARTICULAR NEEDS. YOU SHOULD VERIFY CRITICAL INFORMATION (LIKE ADVICE ABOUT VISAS AND HEALTH AND SAFETY) INDEPENDENTLY BEFORE YOU TRAVEL.

WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE SITES OR THEIR CONTENT AND EXCLUDE, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ANY LIABILITY WHICH MAY ARISE AS A RESULT OF THEIR USE. WE WILL NEVER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL LOSS, OR LOSS OF PROFITS OR REVENUE ARISING OUT OF THE USE OF OUR SITES. YOU INDEMNIFY ME TIME INTERNATIONAL AGAINST EACH CLAIM, ACTION, PROCEEDING, JUDGMENT, DAMAGE, LOSS, EXPENSE OR LIABILITY INCURRED OR SUFFERED BY, OR BROUGHT, MADE OR RECOVERED AGAINST US IN CONNECTION WITH ANY BREACH BY YOU OF THESE TERMS.

Nothing in this Agreement excludes liability for death or personal injury caused by negligence, or liability for fraudulent misrepresentation. Subject to the previous sentence, our liability to you under this Agreement is limited to resupply of the content or services accessed via the sites.

THE FOLLOWING APPLIES TO END USERS WHO LIVE OUTSIDE THE US:

WE USE REASONABLE CARE AND SKILL TO ENSURE THE ACCURACY OF THE INFORMATION PROVIDED ON THE SITES. INFORMATION CONTAINED ON THE SITES MAY NOT BE FULLY ACCURATE AND IS PROVIDED “AS IS”.

However, certain laws also provide non-excludable statutory guarantees, conditions or warranties for the supply of certain goods or services. Nothing in this Agreement is to be taken to exclude, restrict or modify any guarantee, condition or warranty that Me Time International is prohibited by law from excluding restricting or modifying.

Subject to your rights under law (which cannot be excluded), Me Time International: DOES NOT WARRANT OR GUARANTEE THAT THE SITES WILL BE 100% ACCURATE OR CONTINUOUS AT ALL TIMES. THE INFORMATION CONTAINED ON THE SITE IS GENERAL AND MAY NOT BE SUITABLE FOR YOUR PARTICULAR NEEDS; and is not responsible for:

• loss that was not reasonably foreseeable;
• loss that was not caused by Me Time International’s breach of contract or by Me Time International’s negligence;
• business losses (such as lost data, lost profits or business interruptions) or loss suffered by non-consumers;
• losses caused by factors which could reasonably be considered to be outside Me Time International’s control (such as faults in third party equipment);
• any loss caused, or contributed to, by your breach of contract or your negligence.

Subject to the above paragraph, Me Time International is responsible for:

• loss suffered by you as a result of a serious breach of contract by Me Time International if the loss was reasonably foreseeable by both you and Me Time International when this Agreement was entered into; and
• damage to property caused by Me Time International’s negligence if the loss was reasonably foreseeable at the time when this Agreement was entered into.

You must:

• verify critical information (like advice about visas and health and safety) independently before you travel; and
• take all necessary steps to minimize the extent of any loss you may suffer in accordance with this Agreement, and you must notify Me Time International in writing of your loss within 30 days.

Any legal issues will be dealt with under the laws of New York, USA.
